(وإن وطئها) أي: الأَمَة (الموصَى له) بها بعد موت الموصي (كان ذلك قَبولًا) لأنه إنما يُباح في الملك، فتعاطيه دليل اختيار الملك (كالهِبة، فيثبت له الملك به) كقَبوله باللفظ (وكوطء الرجعية) تحصُل به الرجعة.
