(ولا) تصح الوصية (لكافرٍ بمُصْحَفٍ، ولا بعبدٍ مسلم، ولا بسلاح) لأنه لا يصح تمليكه ذلك. (ولا) تصح الوصية لكافر (بحَدِّ قَذْفٍ) يستوفيه للمسلم المقذوف؛ لأنه لا يملك استيفاءه لنفسه، فلغيره أَولى.
