(وتصح) الوصية (للمُكاتَب) لأنه يصح تمليكه (ولو) كان الموصَى له (مكاتَبه) أي: مكاتَب الموصي (بجزء شائع) كثلث ماله وربعه (أو) بشيء (مُعَيَّن) كعبد وثوب؛ لأنه معه كأجنبي في المعاملة، ولهذا جاز دفع زكاته إليه.
