(لكن لو ضاق الثلث عن المُدبَّر، وعن وصيته بُدِئَ) بالبناء للمفعول (بـ) المُدبَّر (نفسه، فيقدَّم عِتقُه على وصيته) لأنه أهم، وبطل ما عجز عنه الثلث.
