(وتصح) الوصية (لأمِّ ولده) لوجود الحرية عند الموت، فَتَقبل التمليك (كوصيته: أن ثلث قريته وقفٌ عليها ما دامت على ولدها) أي: ما دامت حاضنة لولدها منه؛ نقله المرُّوذي .
