(فإن) وصَّى لها بشيء و (شرَط عَدَم تزويجها، فلم تتزوَّج، وأخذت الوصية، ثم تزوَّجت، رَدَّتْ ما أخذت من الوصية) لبطلان الوصية بفوات شرطها، وفرق بينه وبين العتق بتعذُّر رفعه.
