(ولو ردُّوا نصيبَ الوارث وأجازوا للأجنبي، فله الثلث، كإجازتهم للوارث) فيكون له الثلث؛ لأن لهم أن يجيزوا لهما ويردوا عليهما، فلهم أن يُجيزوا لأحدهما ويردوا على الآخر.
