(ولو تلفوا بعد موته من غير تفريط) من الورثة (فكذلك) أي: بطلت الوصية، بمعنى أنه فات على الموصَى له؛ إذ لا موجب للضمان، لحصول التركة في أيديهم بغير فعلهم.
