(وإن وُطِئت) الأَمَةُ الموصَى بنفعها (بشُبهة، فالولد حُرٌّ) لاعتقاد الواطئ أنه وطئ في ملك، كالمغرور بأَمَة (وللورثة قيمته) أي: الولد (عند الوضع على الواطئ) جبرًا لما فاتهم من رِقّه؛ لأنه فَوَّته عليهم.
