(و) وصَّى (لآخر بثلث باقي المال، فلصاحب النصيب ثلث المال) كما لو لم يكن معه وصي آخر (وللآخر ثلث الباقي) وهو (تُسعان مع الإجازة) فتصح من تسعة، لصاحب النصيب ثلاثة، وللآخر تُسعان، ولكل ابن تُسعان
