(وإذا قُسِم ميراثُ ابن الملاعنة، ثم أكذب المُلاعِن نفسه، لَحِقَهُ الولد) وإن لم يكن له ولد ولا قوم ؛ لأنه أقرَّ بحق عليه ولا نظر للتهمة (ونُقِضَت القسمة) كما لو اقتسموا في غيبة بعضهم.
