(ويرث الحملُ ويُورث) عنه ما ملكه، بنحو إرث أو وصية (بشرطين: أحدهما: أن يعلم أنه كان موجودًا حال موت مورِّثه، بأن تأتي به أُمّه لأقل من ستة أشهر) فراشًا كانت أو لا؛ إذ هي أقل مدة الحمل، فحياته دليل أنه كان موجودًا قبل.
