(وإلا) بأن لم تكن متَّهمة في ذلك (سقط) الميراث (كفسخ مُعْتَقةٍ تحت عبد) لأنه لدفع الضرر لا للفرار (أو فعلته) أي: ما يفسخ نكاحها من استدخال ذكر أبيه، أو إرضاع زوجة زوجها الصغير ونحوه (مجنونة) فلا إرث؛ لأنها لا قصد لها.
