(وإن كانا) أي: الشريكان (معسرين) وادعى كل منهما أن الآخر أعتق نصيبه من الرقيق (لم يعتق منه شيء) لأنه ليس في دعوى أحدهما على صاحبه أنه أعتق نصيبه اعتراف بحرية نصيبه؛ لكون عتق المعسر لا يسري إلى غيره.
