(وإن قال) السيد لرقيقه: (متى شئتَ بعد موتي، فأنت حر، أو أيَّ وقت شئتَ بعد موتي) فأنت حر (لم يصح التعليق، ولم يعْتِق) لأن التدبير تعليق العتق بالموت، فلا يمكن حدوثه بعد الموت.
