(وإذا دبَّر شِرْكًا له فِي عبدٍ) أو أمَة (لم يَسْرِ التدبير إِلَى نصيب شريكه، ولو) كان (موسِرًا) لأن التدبير تعليق للعتق بصفة، فلم يَسْرِ، كتعليقه بدخول الدار، ويفارق الاستيلاد، فإنَّه آكد كما تقدم.
