(وإن شهد به) أي: بالتدبير (رجلان، أو رجل وامرأتان، أو) شهد به رجل، و (حلف معه المدبَّر؛ حُكِم به) أي: بالتدبير؛ لأن الشهادة بالتدبير تتضمن إتلاف مال، والمال يُقبَل فيه ما ذكر
