(واختار الموفَّق وجموعٌ) منهم صاحب "المبدع" (أنها) أي: الكتابة (في المرض المخوف من الثلث) لأن ما يأخذه عوضًا، من كسب عبده وهو مال له، فصار كالعتق بغير عوض. وتقدم حكم المحاباة فيها.
