(وولاء من يعتقه) المُكاتَب لسيده (أو) ولاء من (يُكاتبه) إذا أدى ما كُوتب عليه (لسيده، ولو مع عدم عجزه) أي: المُكاتَب (و) عدم (رجوعه إلى الرّق) لأن العتق لا ينفك عن الولاء، والوَّلاء لا يوقف؛ لأنه سبب يورث به، فهو كالنسب
