(وإن أعتقه سيده) فالضمان عليه (أو قتله) سيده (فالضمان عليه) أي: ضمان ما كان على المكاتَب من أقل الأمرين على سيده؛ لأنه بقتله أو عتقه فوَّت على وليِّ الجنابة محل تعلقها، وهو رقبة الجاني، فلزمه ما كان واجبا على الجاني.
