(فإن فعل) بأن وطئ بنت مكاتَبته (فلا حدَّ عليه) لأنها مملوكته، وربما عجزت أمها فعادت لملكه، والحدود تدرأ بالشبهات (ويأثم) بوطئه لابنة مُكاتَبته؛ لما تقدم (ويُعزَّر) عليه (ولها) أي: لبنت المكاتبة (المهر) بوطئه لها (حكمه حكم كَسْبِها، يكون لأمها) تستعين به في كتابتها؛ لأنه بدل منفعة بُضعها، كأجرة خدمتها.
