(ويَعْتق) المُكاتَب (بالأداء إلى سيده) مع أهليته للقبض (و) بالأداء إلى (من يقوم مقامه من ورثته) إن مات؛ لأنه انتقل إليهم مع بقاء الكتابة، فهو كالأداء إلى مورثهم (وغيرهم) أي: غير ورثته: كوليهِ إن جُن أو حُجِر عليه، ووكيلِهِ لقيامه مقام السيد، أشبه ما لو دفع إليه نفسه.
