(وإذا حَلَّ النجم ومالُه) أي: المُكاتَب (حاضر عنده، طُولب به، ولم يجز الفسخ قبل الطلب) لأن الكتابة عقد لازم، ولم يتعذَّر على السيد الوصول للعوض.
