(فإن شَرَطْ السيد على المُكاتَب أن يرثه دون ورثته، أو) شرط السيد على المُكاتَب أنه (يزاحمهم) أي: ورثة المُكاتَب (في مواريثهم؛ فـ) شرط (فاسد) لأنه لا يقتضيه العقد (ولا تفسد الكتابة) به؛ لقصة بَرِيرةَ.
