(ويملك السيد أخذ ما في يده) أي: المكاتب كتابة فاسدة (قبل الأداء، و) يملك -أيضًا- أخذ (ما فَضَل) بيده (بعده) أي: بعد الأداء (لأن كسبه هنا للسيد) لأن العتق هنا بالصفة.
