(لا) يصح النكاح (من القادر على النطق) بإشارة ولا كتابة؛ للاستغناء عنها. (ولا) يصح إيجاب النكاح ولا قَبوله (من أخرس لا تُفهم إشارته) كسائر تصرفاته القولية؛ لعدم الصيغة.
