(وإن تراخى) قبول (عنه) أي: عن الإيجاب (صح، ماداما في المجلس، ولم يتشاغلا بما يقطعه عُرفًا) ولو طال الفصل؛ لأن حكم المجلس حكم حالة العقد، بدليل صحة القبض فيما يشترط لصحته قبضه في المجلس، وبدليل ثبوت الخيار في عقود المعارضات.
