(وإلا) بأن كانت محجورًا عليها لصغر، أو سفه، أو جنون (فيزوِّج أمَتَها وليُّها في مالها) من أب، أو وصيه، أو حاكم، أو قيِّمه فقط (إن كان الحظ في تزويجها) لأن التزويج تصرفٌ في المال، والأمَة مال، ولا إذنَ للمالكة إذًا.
