(ولو وَكَّلَ وليٌّ) غيرُ مجبر في نكاح مَوْلِيَّتِهِ (ثم أذنت) المرأة (للوكيل) أن يزوجها (صح) ذلك (ولو لم تأذن للولي) أن يزوجها، أو أن يوكل؛ لأنه ليس وكيلًا عنها (وهو في كلامهم) قاله في "التنقيح"، وجزم به في "المنتهى" وغيره.
