(لا) ينعقد النكاح (بمُتَّهم لرَحِمٍ، كابني الزوجين، أو ابني أحدهما ونحوه) كأبويهما، وابن أحدهما، وأبي الآخر؛ للتهمة. (ولا) ينعقد النكاح أيضًا (بأصَمَّين، أو أخرسين، أو) بشاهدين (أحدهما كذلك) أي: أصم، أو أخرس؛ لما تقدم.
