(و) إن فُسِخ (بعده) أي: بعد الدخول (أو بعد خلوة) فـ ( لها المُسمَّى) لأنه نكاح صحيح، وُجِدَ بأركانه وشروطه، فترتب عليه أحكام الصحة؛ ولأن المهر يجب بالعقد، ويستقرّ بالخلوة، فلا يسقط بحادث بعده، وكما لو طرأ العيب.
