(وإن كانت المطلَّقة غيرَها) أي: غير الموطوءة (فَوَطْؤُه لها وطءٌ لامرأته) لا شيء عليه به (وكذلك إن كان وَطْؤُه لها قبل طلاقها) فهو وطء لامرأته، لا شيء به عليه.
