(وإن كان) الصداق (ثوبًا، فصبغتْهُ، أو أرضًا، فَبَنَتْها، فَبَذَل الزوجُ قيمة زيادته ليملكه؛ فله ذلك) لأنه يزيل بذلك ضرر الشركة عنه، كالشفيع والمؤجر والمعير إذا بذل قيمة ما بالأرض من البناء، وتملّكه
