(و) لكن إنما (تُمْلَكُ الزيادة من حينها) لا من حيث العقد؛ لأن الملك لا يجوز تقدّمه على سببه ولا وجوده في حال عدمه، وإنما يثبت الملك بعد سببه من حينه
