(وإن قال) الأجنبي: اخْلَعْ زوجتك (على مهرها، أو) على (سلعتها، وأنا ضامن) صحّ (أو) قال: اخْلَعْها (على ألف في ذمتها وأنا ضامن، فيجيبه؛ صحّ) الخلع؛ لأنه باذلٌ للبدل، وذِكْرُ ما أضافه إليها بغير إذنها لغو.
