(وإن نوى الزوجُ بالهِبة) أي بقوله: وهبتك لأهلك، أو لزيد، أو لنفسك (الطلاق في الحال) من غير توقف على قَبول (وقع) الطلاق في الحال (ولم يحتج إِلى قَبولها) كما لو أتى بكناية غيرها ناويًا بها الإيقاع.
