(فإن مات أحدهما قبل وجود الشرط) سقطت اليمين (أو استحال وجوده) أي: الشرط، كأن قال: أنتِ طالق إنْ قتلتِ زيدًا، فمات (سقطت اليمين) ولا حنث؛ لعدم وجود الصفة.
