(فأما في الظاهر؛ فإنها تؤخذ بحكم القتل) لأن قولها غير مقبول في وقوع الثلاث عليه لتدفعه عن نفسها (ما لم يثبت صدقها) بشهادة عدلين، فينتفي وجوب القتل في الظاهر أيضًا.
