(و) إن قال: والله (لا أطؤكنَّ؛ لم يصر مؤليًا) في الحال، لأنه يمكنه وطء كل واحدة بغير حنث (حتى يطأ ثلاثًا، فيصير مؤليًا من الرابعة) لأن المنع حينئذ يصير في الرابعة محققًا، ضرورة الحنث بوطئها، وابتداء المدة حينئذ
