(لا تجب) الكفَّارة (عليها حتى يطأها مطاوعةٌ) كالرجل إذا ظاهر منها (ويجب عليها تمكينُهُ قَبلَها) أي: قبل إخراج الكفارة؛ لأن ذلك حق عليها، ولا يسقط يمينها، كاليمين بالله.
