(وإن وطئ) المظاهِرُ التي ظاهَر منها (قبل التكفير؛ أَثِمَ مكلَّفٌ) منهما، أو من أحدهما؛ لأنه عصى ربه بمخالفته أمره (واستقرَّت عليه) أي: المظاهِر (الكفَّارة، ولو مجنونًا) نص عليه ، فلا تسقط بعد ذلك، كالصلاة إذا غَفَلَ عنها في وقتها.
