(فإن كان العبد كلّه له) أي: لمن عليه الكفّارة (فأعتق جزءًا منه معيّنًا أو مشاعًا؛ عَتَقَ جميعه) بالسِّراية (فإن نوى به الكفّارة؛ أجزأ عنه) لأنه أعتق رقبةً كاملة الرق له، ناويًا بها الكفَّارة، فأجزأته، وظاهر "المنتهى": لا يجزئه.
