(ولا يجوز دفعها) أي: الكفّارة (إلى كافر) كالزكاة. (ولا) يجوز دفعها (إلى قِنٍّ) غير مُكاتَبٍ. وأمّ الولد، والمدبَّر، والمعلّق عتقه بصفة؛ كالقِنِّ الصرف؛ لوجوب نفقتهم على سيّدهم (ولا إلى من تلزمه) أي: المكفِّر (مُؤْنته) كزوجته، وعمودَيْ نسبه، ونحوهم؛ لأن الزكاة لا تُدفع إليهم، فكذا الكفّارة.
