(وحده؛ جاز) لأن الجمع غير واجب، كما يبعث من يستحلفها في الحقوق؛ ولأن الغرض يحصُل ببعث من يثق الحاكم به، فلا ضرورة إلى إحضارها، وترك عادتها، مع حصول الغرض بدونه.
