(وإن أعتق أمَّ ولدِه، أو) أعتق (أمةً كان يُصيبها ممن تحِلُّ له إصابتُها، فله أن يتزوَّجَها في الحال من غير استبراءٍ) لأنها فراشه، كإعادة بائن بغير ثلاث في عدتها.
