(ولا يصح الفسخُ في ذلك كلِّه إلا بحكم حاكم) لأنه فسخٌ مختلَفٌ فيه، فافتقر إلى الحكم، كالفسخ للعُنّة (فيفسخ) الحاكم (بطلبها) لأنه لحقِّها، فلا يستوفيه إلا بطلبها (أو تفسخ) هي (بأمره) أي: الحاكم.
