وإن فعله حاكم من صغير أو مجنون أو وليهما لمصلحة فلا شيء عليه:

كشاف القناعal-Buhuti

(وإن فعله حاكم من صغير أو مجنون) لمصلحة؛ فلا شيء عليه. (أو) فعله (وليهما) أي: ولي الصغير والمجنون (لمصلحة؛ فلا شيء عليه) سواء كان الولي أبًا أو وصيه؛ لأنه محسن بذلك، كما لو ختنه فمات.
