(وإن أمره) أي: العبد سيده (بزنًى أو سرقة فَفَعَل، لم يجب الحد على الآمر) بل على المباشر (جهل المأمور التحريم، أوْ لا) لكن إذا جهل تحريم الزنى، فلا حَدَّ عليه كما يأتي في بابه.
