(ولو قال مكلَّفٌ غيرُ قِنٍّ لغيره: اقتُلني، أو اجْرَحني) ففعل، فهدر. (أو) قال مكلف لغيره: (اقتُلْني، وإلا قتلتُكَ، ففعل، فدَمُه) هَدْر (وجُرحه هَدْر) لأن الحق له فيه، وقد أذنه في إتلافه، كما لو أذنه في إتلاف ماله.
