كشاف القناعal-Buhuti

(ولو قاله) أي: اقتلْني، أو اجرحْني، أو: اقتلْني وإلا قتلتك (قِنٌّ) ففعل (ضَمِنه القاتلُ لسيده بمال) أي: بقيمته أو أرش الجراحة؛ لأن إذن القِنّ في إتلاف نفسه لا يسري على سيده (فقط) أي: دون القِصاص ولو كافأه القاتل؛ لأن القِصاص حقٌّ للقِن، وقد أسقطه بإذنه في قتله.
